CRIMINAL PETITION NO.3980 OF 2012

ORDER:

This Criminal Petition is filed under Section 482 Cr.P.C. seeking to quash proceedings against the petitioners-accused in C.C.No.44 of 2011 on the file of Judicial Magistrate of First Class, Yemmiganur, Kurnool District.

Heard both sides.

Learned Public Prosecutor submitted that police, after completion of investigation in Crime No.50 of 2011 of Yemmiganur Town Police Station, filed charge sheet before the Judicial Magistrate of First Class, Yemmiganur, and the same is registered as P.R.C.No.44 of 2011. Subsequently, on committal, the same is registered as S.C.No.538 of 2012 and pending on the file of Assistant Sessions Judge, Adoni.

Now the request of advocate for petitioners is, by mistake, it is typed as C.C.No.44 of 2011 instead of P.R.C.No.44 of 2011 and since the Sessions Case is now registered, he wants to file an amendment petition and argue the case, as for that time is to be granted.

I am not inclined to grant time since the crime is of the year 2011 and Sessions Case is already registered on the basis of committal order. The petitioners can as well urge these grounds at the time of framing of charges before the concerned Sessions Judge. Even otherwise, they can avail remedies available under law including filing of discharge petition.

With the above observation, this Criminal Petition is disposed of. Miscellaneous petitions, if any, pending shall stand closed.
