CRIMINAL PETITION No. 3480 of 2012

ORDER:

This petition is filed to quash proceedings in C.C.No.31 of 2012 on the file of the XI Additional Chief Metropolitan Magistrate, Secunderabad for alleged offences under Sections 407 and 420 IPC.

2. Heard both sides.

3. The main contention of the learned counsel for the petitioners is that the dispute between parties is of civil nature and the breach of contract was converted into a criminal case.

4. On the other hand, advocate for complainant submitted that it is a clear case of cheating and criminal breach of trust and the case is at the stage of trial.

¶8

5. I have perused the material papers filed along with the criminal petition including documents. All the grounds urged in the petition are defences available to the petitioners and they can as well urge them before the trial Court since trial is already commenced.

6. Considering the submissions of both sides, directing the trial Court to take up trial of the case and dispose of it, as expeditiously as possible, preferably within six months

from the date of receipt of a copy of this order and the trial Court shall consider the grounds urged here by the petitioners without being influenced by dismissal of this application.

7. With the above direction, the criminal petition is disposed of. As a sequel, miscellaneous petitions, if any filed in this criminal petition, shall stand closed.
