These Criminal Petitions are filed under Section 438 Cr.P.C by petitioner seeking anticipatory bail in connection with a case in Crime Nos.287/2013, 143 of 2013, 189 of 2013, 144 of 2013 and 372 of 2013 of Devarakonda PS, Chandampet PS, Gudipalli PS, Chandampet PS and Devarakonda PS, Nalgonda District respectively registered for the offences punishable under Sections 409, 420 and 477 IPC.

2. Heard the Learned Counsel for the Petitioner, the Learned Additional Public Prosecutor for the Respondent-State and perused the material placed on record.

The present petition is filed by the petitioner as the petitioner is apprehending arrest in Crime Nos.287 of 2013 of Devarakonda Police Station, 143 of 2013 of Chandampet Police Station, 189 of 2013 of Gudipalli Police Station, 144 of 2013 of Chandampet Police Station and 372 of 2013 of Devarakonda Police station.

4. Learned counsel for the petitioner submitted that the petitioner is working as General Manager and he is at the verge of retirement, so far he rendered his services to the Bank without any remark.

Having regard to the circumstances stated in the petition as well as the submissions made by the learned counsel, instead of dismissing from not entitled to the pre-arrest bail, but for regular bail in considering his personal liberty, this application is disposed of, by giving liberty to the petitioner-accused to surrender before the Learned Magistrate concerned to take into custody under Section 44 Cr.P.C by virtue of this order, move before the learned Judge/ Magistrate for regular bail and with notice to learned Additional/ Assistant Public Prosecutor concerned and in such an event, the learned Judge/Magistrate shall consider for granting

of bail in favour of the petitioner with necessary conditions, which includes the petitioner shall attend before the Sub-Divisional Police Officer concerned regularly on every Sunday until further orders apart from his appearance as and when required for further investigation, preferably on the same day if not atleast by the next day.

In the event of the police making out a case for police custody for the purpose of interrogation, the petitioner shall be liable to be taken in police custody for facilitating the further investigation remained if any, with the permission of the Magistrate concerned, within 15 days from today, who can grant such police custody, subject to necessary precautions and instructions as per the constitutional bench expression of Apex Court in guideline No.iv in Gurbaksh Singh Sibbia Vs. State of Punjab^[1] .

7. Accordingly, the criminal petitions are disposed of.
