CRIMINAL PETITION No.10511 of 2014

ORDER

The present application is filed under Section 482 of the Code of Criminal Procedure, 1973, seeking quashing of all further proceedings in C.C.No.524 of 2014 on the file of II Additional Judicial First Class Magistrate, Eluru, West Godavari District. A charge sheet came to be filed against the petitioners/A2 to A5 and another for the offences punishable under Sections 498-A and 406 IPC read with Sections 3 and 4 of Dowry Prohibition Act.

Though the present application is filed seeking quashing of all further proceedings, learned counsel for the petitioners restricts his prayer seeking dispensation of the presence of the petitioners before the trial Court on the ground that the petitioners are residents of Hyderabad and it is difficult for them to attend the Court at Eluru on every date of adjournment.

3. Learned Public Prosecutor submits that since there is no dispute with regard to the identity of the petitioners, their presence may not be necessary on every date of adjournment.

The material placed on record would show that petitioners 1 and 2 are in-laws while petitioners 3 and 4 are sister-in-laws of the informant and all the petitioners are staying with the informant at Hyderabad. Having regard to the nature of allegations made against the petitioners and as there is no dispute with regard to their identity, their presence in C.C.No.524 of 2014 on the file of the II Additional Judicial First Class Magistrate, Eluru, West Godavari District, is hereby dispensed with except on the dates when their presence is specifically required by the said Court.

5. With the above direction, the Criminal Petition is disposed of. As a sequel thereto, Miscellaneous Petitions, if any, pending in this Criminal Petition, shall stand closed.
