ORDER:
This application is filed for permitting the Official Liquidator to appoint an advocate to defend in Special Leave to Appeal (C) Nos.10437-10438 of 2014 before the Supreme Court in the matter of M/s. Tungabhadra Industries Limited (in liquidation) and fix the advocate’s fees.
A perusal of the record shows that against the common judgment dated 06.12.2013 in O.S.A.Nos.52 of 2011 and 41 of 2013, Special Leave Petitions were filed by the aggrieved party. The Supreme Court, by order dated 28.04.2014, issued notice returnable in ten weeks, while directing that the parties shall not create any third party interest with regard to the property in question. The Deputy Official Liquidator, therefore, sought for permission of the Court to engage either of the two advocates, namely; Mr. M. Srinivas R. Rao or Mr. S. Udaya Kumar Sagar, to defend the company in liquidation in the said case and also for fixing his fees.
Having regard to the above facts, Mr. M. Srinivas R. Rao, Advocate, is permitted to be engaged by the Official Liquidator. His fees is tentatively fixed as Rs.25,000/- (Rupees Twenty Five Thousand only), which may be varied in future depending upon the work involved and services rendered by him.
The company application is accordingly disposed of.
