JUDGMENT :
Learned Counsel for the appellants seeks permission of this Court to withdraw this appeal. He also filed a letter dated 10-12-2014 to that effect. He further submits that the 1st appellant died and the
2nd appellant is only the legal heir of the 1st appellant. Memo. dated
10-12-2014 is also filed to that effect.
Recording the Memo. dated 10-12-2014 filed by the learned counsel for the appellants regarding the death of the 1st appellant and that the 2nd appellant is only the legal heir of the 1st appellant, permission is accorded to withdraw the Appeal Suit.
Accordingly, the Appeal Suit is dismissed as withdrawn.
No order as to costs. Consequently, the miscellaneous petitions, if any pending in this appeal, shall stand dismissed.
