APPEAL SUIT No.2104 OF 1996
JUDGMENT:
Sri O. Manohar Reddy, learned counsel for the appellant, submits that the appellant died long back and the appeal was also dismissed against the 2nd respondent for default on 16.10.2001, and later he also died. However, no steps were taken to implead the legal representatives of either the appellant or the 2nd respondent.
As the appellant died long back and no steps were taken to implead her legal representatives, the appeal is deemed to have been dismissed as abated due to operation of law.
The Appeal Suit is, accordingly, dismissed as abated due to operation of law. There shall be no order as to costs.
Miscellaneous petitions, if any, filed in this Appeal Suit shall stand closed.
