ORDER:

The petitioner states that she has constructed a house in an extent of Ac.0.08 cents of Government land in Sy.No.69/3 of Addateegala Village and Mandal, East Godavari District, long ago. The Special Deputy Tahsildar (T.W.), Addateegala Mandal, 4^th respondent herein initiated proceedings in LTRP No.56 of 2010, before the Special Deputy Collector, Rampachodavaram, 2^nd respondent herein, under the Andhra Pradesh Scheduled Areas Land Transfer Regulation. The 2^nd respondent passed an order, dated 23.11.2012, directing eviction of petitioner from the land/house.

The petitioner filed an appeal before the Additional Agent to the Government, Rampachodavaram, 1^st respondent herein, feeling aggrieved by the orders of the 2^nd respondent. An application for stay was also filed. The grievance of the petitioner is that the 1^st respondent did not pass any orders in the application for stay and that in the meanwhile, the respondents 3 and 4 are trying to evict her.

Heard the learned counsel for the petitioner and the learned Government Pleader for Social Welfare.

The petitioner has already availed the remedy of appeal, feeling aggrieved by the orders passed by the 2^nd respondent. In case, she is evicted from the land even while the appeal is pending, the very purpose of availing the remedy is defeated.

Hence, the writ petition is disposed of directing that the order, dated 23.11.2012, passed by the 2^nd respondent in

LTRP No.56 of 2010, shall remain suspended, till the 1^st respondent disposes of the appeal, preferred by the petitioner. There shall be no order as to costs. Miscellaneous petitions filed in this writ petition shall also stand disposed of.
