ORDER:

The 1^st petitioner is an Educational Society and has established the 2^nd petitioner College at Rajarampally Village, Velgatoor Mandal, Karimnagar District. The A.P. State Council for Higher Education –

2^nd respondent, issued notification on 16-01-2013, inviting applications for establishment of Aided Private Degree Colleges in various Mandals including Velgatoor Mandal. The grievance of the petitioner is that if the new colleges are established in the Mandal, on one hand it is in violation of the terms, specified in the notification, and on the other hand, they would adversely effect the existing ones.

2. Heard the learned counsel for the petitioner, learned Government Pleader for Higher Education and the learned Standing Counsel for the 3^rd respondent.

3. The 2^nd respondent issued notification, in exercise of powers under Section 20 of the A.P. Education Act. Before any Mandal is notified for establishment of new Degree College, the 2^nd respondent takes the statistics of the outgoing students from the Junior Colleges within the Mandal. The inclusion of Velgatoor Mandal for establishment of new Degree College is obviously on the basis of the statistics that are available with the 2^nd respondent. Therefore, issuance of notification and inclusion of Velgatoor Mandal in the notification, cannot be said to be either illegal or arbitrary. Be that as it may, if more applications are received by the respondents, seeking permission for establishment of Degree College in the Velgatoor

Mandal, the potential for them to run, must be taken into account, particularly, having regard to the number of outgoing students in intermediate and the number of Degree Colleges that are already existing.

4. The Writ Petition is, accordingly, disposed of. There shall be no order as to costs. The miscellaneous petition filed in this writ petition shall also stand disposed of.
