ORDER:
The relief sought for in this Writ Petition is to declare the action of the respondents including the petitioner’s land covered in R.S. No.42/3 of an extent of Ac.1.04 cts situated at Krsihnapuram @ Vedantapuram village, Koyyalagudem Mandal, West Godavari District as Adavi Poramboku instead of private patta land, as arbitrary and illegal and also direct the respondents to rectify the mistake in the revenue records in respect of the land covered in RS No.42/3 as a private patta land in the place of Adavi Poramboke situated at Vedantapuram village, Koyyalagudem Mandal, West Godavari District.
Learned Government Pleader for Revenue (Andhra and Rayalaseema Areas) would submit that, if an application in Form VI-A, in terms of Section 4(1) of the Andhra Pradesh Rights in Land and Pattadar Pass Books Act, 1971 (the Act), and Rule 18 of the Andhra Pradesh Rights in Land and Pattadar Pass Books Rules, 1989 (the Rules), is filed by the petitioner, the fourth respondent would consider the same, in accordance with law, and pass orders thereupon at the earliest.
Sri P.R.K. Amarendera Kumar, Learned Counsel for the petitioner, would submit that an application, in the prescribed form, would be filed within two weeks from the date of receipt of a copy of the order. In case such an application is filed, in accordance with the form prescribed under the Act and the Rules made thereunder, within the aforesaid period, the fourth respondent shall consider the same, and pass orders thereupon, in accordance with law within two months thereafter.
The Writ Petition is, accordingly, disposed of. The
Miscellaneous Petition pending, if any, shall also stand disposed of. However, in the circumstances, without costs.
