The Court made the following: ORDER:
This Writ Petition is filed for the following substantive relief:
“…… to issue a Writ, order or direction, more particularly one in the nature of Writ of Mandamus declaring the action of respondent No.2 in not calling open tenders for supply of Manpower from the registered Outsourcing Agencies as illegal and arbitrary and consequently, to direct respondent No.2 to follow G.O.Rt.No.4459, dated 27.12.2006, issued by respondent No.1 in respect of appointment of outsourcing agencies by calling open tenders for the supply of manpower in the Government and nonGovernmental organizations, not to recruit any manpower from respondent No.4 without calling for open tenders.”
After arguing the case, Sri T.Sudhakar Reddy, the
learned counsel for the petitioners, on realising that before filing this Writ Petition his clients have not approached respondent No.2 sensitizing it on the need to follow the tender process as directed by this Court in order, dated 23.04.2013, in WPMP.No.35526 of 2012 in Writ Petition No.45146 of 2012, requested for permission of the Court to withdraw the Writ Petition with liberty to his clients to approach respondent No.2 to follow the abovementioned order of this Court and avail fresh remedies, in the event, respondent No.2 does not accede to the petitioners’ requests.
The Writ Petition is, accordingly, dismissed as withdrawn with liberty to the petitioners in terms of the prayer made.
As a sequel to dismissal of the Writ Petition, W.P.M.P.No.37831 of 2013 filed by the petitioners for interim relief is dismissed as infructuous.
