The petitioner company is aggrieved by the action of the Northern Power Distribution Company of Andhra Pradesh Limited (APNPDCL) in disallowing seasonal benefit

to it. Aggrieved thereby, the petitioner company approached the Consumer Grievances Redressal Forum of the APNPDCL at Warangal in C.G.No. 40/2013-14 of Adilabad Circle. The Forum, by order dated 05-08-2013, upheld the action of the APNPDCL.

Section 42(6) of the Electricity Act, 2003 (for brevity, the Act of 2003), provides that any consumer aggrieved by the non-redressal of his grievance by the Forum may make a representation to the Ombudsman appointed by the Andhra Pradesh Electricity Regulatory Commission. This aspect of the matter is spelt out by the Forum itself in its order dated 05-08-2013, wherein it stated that if the petitioner company is aggrieved by its order, it could approach the Vidyut Ombudsman, Andhra Pradesh Electricity Regulatory Commission at Hyderabad.

3. In the light of the statutory remedy provided to the petitioner company against the order of the Consumer Grievances Redressal Forum of the APNPDCL at Warangal, this Court is not inclined to entertain this Writ Petition.

4. The Writ Petition is accordingly closed leaving it open to the petitioner company to invoke the statutory remedy available to it under Section 42(6) of the Act of 2003 in

accordance with law. W.P.M.P.No. 32939 of 2013 shall stand closed in the light of this final order. No order as to costs.
