ORDER:
This Writ Petition is filed for the following substantive relief:
“…to issue a Writ or order or orders more particularly in the nature of writ of Mandamus declaring the action of the 1st respondent in not issuing the Tender Form to the petitioner in connection with tender notification dated 13-08-2012 in SMPP/CS/2012-13/LTE/PR-200033006 for the work of “AREA MAINTENANCE WORKS OF OLD ADMN BUILDING, NEW ADMN BUILDING, IT AND DOC BUILDING, OPERATION OF MAIN PH. BOOSTER PH OF STP, MAINTENANCE OF WATER SUPPLY SYSTEM IN PLANT BUILDINGS UPKEEP OF ROADS AND CLEANING OF OH TANKS IN NTPC-SIMHADRI FOR THE YEAR 2012-2013” as illegal, Arbitrary, unjustified and also in violation of principles of Natural Justice and consequently direct the 1st respondent to act in accordance with law in issuing the tender forms.”
On 01-02-2013, the case was adjourned, as it was represented on behalf of the learned counsel for the petitioner that the arguing counsel was bereaved. Today, when the case is called, there is no representation for the petitioner. Hence, it is reasonable to presume that the petitioner is not interested in pursuing its cause in the writ petition.
The writ petition is accordingly dismissed for non-prosecution. As a sequel to dismissal of the writ petition, W.P.M.P.No.33349
of 2012 filed by the petitioner for interim relief, stands disposed of as infructuous.
