The Court made the following: ORDER:
This Writ Petition is filed for the following substantive
relief:
“…to issue a writ, order or direction more particularly one in the nature of writ of Mandamus to declare the action of respondent authorities particularly, respondent No.2, in seizing the bore-well of the petitioner situated in the land admeasuring Ac.4.98 cents in Sy.No.873/2 of Kondapalli Village, H/o Tumucherla, Kanaganapalli Mandal, Anantapur District, vide Patta No.2048, without putting the petitioner on notice as illegal, arbitrary and violation of principles of natural justice and consequently, to direct official respondent authorities to regularize the bore-well of the petitioner on payment of requisite fee as directed by the official respondent authorities in accordance with law.”
Sri P.Kasi Nageswar Rao, the learned counsel for the petitioner, filed WPMP.No.41393 of 2013 requesting for permission of the Court to withdraw the Writ Petition with liberty to his client to file a fresh Writ Petition. He has also addressed letter, dated 29.11.2013, to the Registry seeking to post the Writ Petition under the caption “for
withdrawal.”
At the hearing, the learned counsel for the petitioner, submitted that as Annexure-I filed in the Writ Petition is incomplete, his client may be permitted to withdraw the Writ Petition with liberty to file a fresh Writ Petition with proper Annexure-I.
The Writ Petition is, accordingly, dismissed as withdrawn with liberty to the petitioner in terms of the prayer made.
As a sequel to dismissal of the Writ Petition, WPMP No.41393 of 2013 is allowed and W.P.M.P.No.30972 of 2013 is dismissed as infructuous.
