WRIT PETITION No.24779 OF 2010

ORDER:

This Writ Petition is filed by the petitioners seeking to issue Writ o f Mandamus declaring the action of the respondents 1 to 3 in not paying compensation to the petitioners in respect of land to the extent of Acs.24.65 cents situated in Survey No.88, 89, 301, 325/1, 351 and 125 of Kalanuthala Village, Peddaraveedu Mandal, Prakasam District, or alternatively not referring the dispute to competent Civil Court in spite of requisition to that effect on 20-09-2010 as illegal, arbitrary and violation of provisions of Land Acquisition Act and Articles 14, 21 and 300-A of the Constitution of India, and consequently to direct the respondents either to pay compensation to the petitioners or to refer the dispute for decision to the competent Civil Court.

2. Initially, in this writ petition, this Court ordered notice before admission on 05-10-2010, and then admitted the writ petition on 08-11-2010, and also ordered the notice in W.P.M.P. No. 31709 of 2010, wherein the petitioners sought for interim relief directing the respondents not to disburse compensation payable in respect of the aforesaid extent of the land.

3. Today the matter is listed under caption of “ WITHDRAWAL” basing on the letter dated 24-01-2013 addressed to the Registrar. Having regard to the request made in the letter dated 24-01-2013, petitioners are permitted to withdraw the writ petition.

Accordingly, the Writ Petition is dismissed as withdrawn. Consequently, miscellaneous petitions, if any, pending in this writ petition, shall stand dismissed. There shall be no order as to costs.
