Entertaining Writ Petition No. 8198 of 2013, this Court passed detailed order by its order dated 19-3-2013, which runs as under :

“ This writ petition is being disposed of at the admission stage as agreed to by Smt. N. Niyatha, learned counsel appearing for the petitioner as well as Sri R. Radhakrishna Reddy, learned Standing Counsel appearing for respondent Nos.2 and 3-Greater Hyderabad Municipal Corporation against whom the relief in the writ petition is sought for.

2. The petitioner claims to be the owner and possessor of Plot No.161 in Sy.No.66/3 situated in Raidurg Navkhalsa Village, Serilingampally Mandal, Ranga Reddy District. The grievance of the petitioner is that though he submitted an application for regularization of the said plot under Layout Regularisation Scheme, the said application has not been considered on the ground that the land in the aforesaid survey number is Government land.

The question whether the aforesaid land is Government land was conclusively decided by a judgment of this Court in A.S.No.37 of 2006, dated 29.9.2008 and the same has been confirmed by the Supreme Court by judgment in (Civil) C.C.No.10830-10834 of 2011, dated 4.1.2012. Thus, no objection can be taken by respondent Nos.2 and 3 to regularize the plot of the petitioner on the said ground. However, the petitioner cannot seek regularization as a matter of course, unless he complies with the norms prescribed therefor, which include payment of charges towards regularization.

4. In view of the same, this writ petition is disposed of as agreed to by both the learned counsel, directing that the

petitioner shall deposit a sum of Rs.1,00,000/- (Rupees one lakh only) or 50% of the Land Regularisation Scheme amount within thirty days from the date of receipt of a copy of this order and upon receipt of the said amount, the 2^nd respondent will process the application and intimate the total amount payable by the petitioner. Upon payment of the total amount so intimated, the application of the petitioner may be dealt with and dispose of the same in accordance with law within thirty days thereafter. No order as to costs.

5. In view of the disposal of the writ petition, W.P.M.P.No.10247 of 2013 is dismissed as unnecessary.

In the circumstances, let there be a similar order in this case as well. The Writ Petition stands disposed of in terms of the above order. No costs.
