WRIT PETITION No.1507 of 2013

ORDER:

The relief sought for in this Writ Petition is to declare the action of the respondents in not considering the application of the petitioner dated 28.10.2012, as arbitrary and illegal. A consequential direction is sought to the respondents to issue pattadar pass books and title deeds in favour of the petitioner in respect of the land covered in R.S.No.95 admeasuring Ac.5.19 cents situated at Barrinkalapadu Village of Jeelugumelli Mandal in West Godavari District.

Learned Government Pleader for Revenue (Andhra and Rayalaseema Areas) would submit that, if an application in Form VI-A, in terms of Section 4(1) of the Andhra Pradesh Rights in Land and Pattadar Pass Books Act, 1971 (the Act), and Rule 18 of the Andhra Pradesh Rights in Land and Pattadar Pass Books Rules, 1989 (the Rules), is filed by the petitioner, the second respondent would consider the same, in accordance with law, and pass orders thereupon at the earliest.

Sri P.R.K.Amarender Kumar, learned Counsel for the petitioner, would submit that an application, in the prescribed form, would be filed within two weeks from the date of receipt of a copy of the order. In case such an application is filed, in accordance with the form prescribed under the Act and the Rules made thereunder, within the aforesaid period, the second respondent shall consider the same, and pass orders thereupon, in accordance with law within two months thereafter.

The Writ Petition is, accordingly, disposed of. The miscellaneous petitions pending, if any, shall also stand disposed of. There shall be no order as to costs.
