WRIT PETITION No.1193 of 2013

ORDER:

The relief sought for in this Writ Petition is to declare the action of the fourth respondent in not granting the pattadar pass books and title deeds to the petitioners in respect of the land in Survey No.173 admeasuring Acs.7.26 guntas each totally admeasuring Acs.15.12 guntas situated at Govardhanagiri Village and Gram Panchayat, Raghunathpally Mandal in Warangal District, as arbitrary and illegal. A consequential direction is sought to the fourth respondent to issue pattadar pass books and title deeds to the petitioners.

Learned Government Pleader for Revenue (Telangana Area) would submit that, if an application in Form VI-A, in terms of Section 4(1) of the Andhra Pradesh Rights in Land and Pattadar Pass Books Act, 1971 (the Act), and Rule 18 of the Andhra Pradesh Rights in Land and Pattadar Pass Books Rules, 1989 (the Rules), is filed by the petitioners, the fourth respondent would consider the same, in accordance with law, and pass orders thereupon at the earliest.

Sri Parsa Ananth Nageswar Rao, learned Counsel for the petitioners, would submit that an application, in the prescribed form, would be filed within two weeks from the date of receipt of a copy of the order. In case such an application is filed, in accordance with the form prescribed under the Act and the Rules made thereunder, within the aforesaid period, the fourth respondent shall consider the same, and pass orders thereupon, in accordance with law within two months thereafter.

The Writ Petition is, accordingly, disposed of. The miscellaneous petitions pending, if any, shall also stand disposed of. There shall be no order as to costs.
