COMMON ORDER:

The grievance of the petitioners in this batch of cases is with regard to interference by the authorities of the Fisheries Department with their aquaculture operations. It is their case that they submitted applications under the erstwhile G.O.Ms.No.83, Animal Husbandry, Dairy Development and Fisheries (Fish.II) Department dated 12.09.2007 read with G.O.Ms.No.18, Animal Husbandry, Dairy Development and Fisheries (Fish.II) Department, dated 26.03.2008 and therefore, they should be deemed to have authorization to continue with their aquaculture operations.

2. The admitted fact of the matter however is that none of the petitioners have regularization/registration of their aquaculture ponds. The Government of Andhra Pradesh issued consolidated orders with

reference to fresh water aquaculture in the State under G.O.Ms.No.7, Animal Husbandry, Dairy Development and Fisheries (Fish.II) Department, dated 16.03.2013. Existing un-registered aquaculture ponds as well as new ponds have to submit their applications under this G.O. for regularization/registration. The G.O. also stipulates the terms and conditions applicable to existing aquaculture ponds and their activities.

The writ petitions are accordingly disposed of directing the petitioners to submit their applications afresh in terms of the requirements of G.O.Ms.No.7 dated 16.03.2013 within three weeks from the date of receipt of a copy of this order. Upon receipt of such applications, the same shall be processed by the competent authority as per the procedure prescribed under G.O.Ms.No.7 dated 16.03.2013, including the time stipulation for disposal of such applications. Pending miscellaneous petitions in this batch of writ petitions shall stand closed in the light of this final order. No order as to costs.
