COMMON JUDGMENT: (per the Hon’ble Sri Justice N.V.Ramana)

Heard learned counsel for the appellants and the learned standing counsel for the respondent.

We have already heard the writ appeal No.827 of 2013 on 18.06.2013 and passed interim order. The appellants claim that they are in possession from 1974 and constructed houses, which are assessed to tax, which the appellants are paying, whereas on the contrary the respondent claims that the property belongs to the temple and that the construction thereon by the appellants was objected by the temple authorities.

However, learned Standing Counsel for the respondent submits that he would file counter-affidavit in the writ petitions in two (2) weeks. Since we had already directed status quo to be maintained by both parties regarding the subject matter of respective writ petitions, we deem it appropriate to dispose of these appeals directing that status quo shall be maintained by both the parties regarding the subject matter of the respective writ petitions pending disposal of the writ petitions. In the meanwhile the respondent shall file counter-affidavits in both the writ petitions, so that the writ petitions can be heard and disposed of at an early date. The conditional order passed by the learned single Judge is accordingly modified. Both the appeals stand disposed of accordingly. There shall be no order as to costs.
