JUDGMENT: (Per the Hon’ble the Chief Justice Sri Pinaki Chandra Ghose)
When the matter came up on 08.02.2013 none appeared for the appellant. Hence, the matter was adjourned for two weeks under the caption ‘for dismissal’. Again when the matter came up on 22.02.2013, since notices were not served on the respondents, this Court issued notice to the respondents and directed the matter to be listed today under the same caption. Today, when the matter has come up under the caption ‘for dismissal’ no one appeared on behalf of the appellant. It is therefore reasonable to presume that the appellant is not interested to pursue the cause in the writ appeal.
The writ appeal is therefore dismissed for default. No costs.
