Order:
This Transfer CMP is filed seeking to withdraw FCOP No. 1013 of 2012 from the file of the Judge, Family Court, R.R. District at L.B. Nagar, and transfer the same to the file of the Senior Civil Judge, Bobbili, Vizianagaram District.
The petitioner is the wife of the respondent. Their marriage was solemnized on 07.02.2007. The petitioner filed DVC Case No. 9 of 2012 and M.C. No.45 of 2012 on the file of the Additional Judicial Magistrate of First Class, Bobbili, Vizianagaram District. The petitioner’s case is that she is ready and willing to join the respondent, but he refused to receive her. She is residing with her father at Bobbili. According to her, the respondent is appearing the Courts at Bobbili and that she is unable to attend the Court at R.R. district along with her two year old child. Her further case is that she is not employed anywhere and that she would attend the Court at Ranga Reddy District if she is paid expenses of Rs.10,000/- per each trip.
However, having regard to the difficulties expressed by the petitioner and the fact that DVC Case and Maintenance Case are already pending at Bobbili Courts, FCOP No. 1013 of 2012 is withdrawn from the file of the Judge, Family Court, R.R. District at L.B. Nagar, and transferred the same to the file of the Senior Civil Judge, Bobbili, Vizianagaram District.
The transfer CMP is accordingly allowed. No costs.
