The petitioner is the wife of the respondent. The respondent filed O.P. No.743 of 2012 on the file of the Judge, Family Court, City Civil Court, Hyderabad, seeking divorce. He has given his address as resident of Plot Nos.20 and 21, National Police Academy, Sivarampally, Hyderabad. The petitioner filed this transfer CMP seeking transfer of O.P. No.743 of 2012 pending on the file of the Judge, Family Court, City Civil Court, Hyderabad, to the Court of the Senior Civil Judge, Mahabubabad, Warangal District. Notices have been sent to the same address given by the respondent in his OP No.743 of 2012 through registered post. Since the notices have been sent to the same address given by the respondent it is deemed that the notices have been served on the respondent.

The marriage of the petitioner was solemnized on 20.08.2008. The petitioner lodged a complaint which is registered as FIR No.97 of 2012 of Kesamudram PS, Warangal District. The petitioner’s case is that Hyderabad is at a distance of 200 KMs from her native place and she cannot travel along with her two minor children and she cannot meet the traveling expenses and there is life threat to her at Hyderabad.

In the circumstances, the transfer CMP is allowed and O.P. No.743 of 2012 is withdrawn from the file of the Judge, Family Court, City Civil Court, Hyderabad, and transferred to the Senior Civil Judge Court, Mahabubabad, Warangal District. No costs.
