JUDGMENT:
As there was no representation for the appellant on 29-01-2013, the matter was directed to be listed under the caption “for dismissal”.
2. On 08-02-2013, the counsel for the appellant appeared and sought time, as such, the matter was again directed to be listed under the same caption i.e., “for dismissal” after two weeks.
3. In spite of the matter being listed today under the caption “for dismissal”, when the matter came up for hearing, there is no representation on behalf of either side.
4. Therefore, the Second Appeal is dismissed for default. Consequently, the Miscellaneous Applications, if any, pending in this appeal shall stand closed. No order as to costs.
