Civil Revision Petition No. 3792 of 2013
Order:
This CRP is directed against the orders dated 24.02.2009 passed in E.P. No.108 of 2006 in O.S. No.166 of 2004 by the Senior Civil Judge, Gudur, Nellore District.
This Court, on 03.09.2013, passed the following order in CRPMP No.7051 of 2009 in CRP No.3792 of 2013.
“The civil revision petition pertains to the year 2009. Admittedly, the petitioner suffered a money decree and is yet to clear the dues. It is stated that after the amount deposited is taken into account, a sum of Rs.1,00,000/- and over is still due and payable.
There shall be a further direction to the petitioner to deposit a sum of Rs.50,000/- (Rupees Fifty thousand only) to the credit of the EP within six (6) weeks from today and the respondent-decree-holder is permitted to withdraw the same without furnishing security.
Post on 30.10.2013.”
It is not in dispute that the petitioner has not complied with the said orders of this Court passed on 03.09.2013. In the circumstances, the CRP is dismissed for non-prosecution. No costs.
As a sequel, the miscellaneous petitions, if any, pending in this CRP shall stand cancelled.
