There was a land dispute between the father of the petitioner viz., Kudikayala Papaiah and the elder brother of the accused viz., Maddi Narsaiah. Due to the said dispute, the accused and Maddi Lachaiah, who are brothers of Maddi Narsaiah came to the house of the petitioner on 7.6.2004 at about 7.30 a.m., while Kudikyala Papaiah was sitting in front of his house, they started abusing him and beating him. When the petitioner tried to rescue his father, the accused picked up a tapers knife from Moku tied to his waist and inflicted knife injury on the left side of his waist. Maddi Lachaiah also beat the petitioner with hands and caused bleeding injuries. The accused caused scratch injury on the cheek of Kudikyala Papaiah and caused bleeding injury. One Oggu Ramulu and Mamidi Chinna Mallaiah saw the incident and intervened and rescued the petitioner and his father from the hands of the accused. Thereafter, the petitioner presented a report, basing on which a case was registered and investigated into. After completion of the investigation, charge sheet was filed before the Additional Judicial Magistrate of First Class, Karimnagar. The learned Magistrate took cognizance of the case for the offence under Section 307 IPC and committed the case to the Court of Sessions, Sessions Division, Karimnagar. The learned District & Sessions Judge, Karimnagar registered the case as S.C.No.743 of 2005 and made over the same to the Assistant Sessions Judge, Karimnagar for disposal. 3. It appears that Maddi Lachaiah died after the incident and hence, the case against him has been abated.
