incident at about 8.00 AM., when A1 and A2 started digging a canal at the place where they placed earth, Rapa Apparao, who is no more, questioned and touched them, then A1 abused him saying ‘Mala Lanjakoduka Yenta Dhairyam Vunte Mammulanu Muttukuni Addagisthava’ and so abusing, A1 attempted to beat Apparao with a spade, immediately, he rushed to the spot and caught hold of the spade, then A1 kicked with his leg on the chest of Apparao, A2 by saying ‘Mala Lanja Koduka’ caught hold of his shirt collar and gave a slap on his right ear, then, himself and Apparao fell down and thereafter, they reported the matter to the police. P.W.2, who is the brother of P.W.1, deposed that on the date of incident, when Apparao raised objection by touching the hand of A1, A1 abused him in filthy language in the name of his caste as “Neeyamma Mala Puku Denga Mammalani Muttukuntava, and lifted the spade, then P.W.1 intercepted and A1 kicked on the chest of Apparao with his leg and he fell down, then A2 abused P.W.1 in filthy language in the name of his caste as “Neeyamma Mala Puku Denga Neeku Yenta Geera Ra Nuvvu Chaduvukunnavana Mammalani Muttukuntava” and by holding his shirt collar, he slapped on his cheek. P.W.3, the wife of the deceased Apparao, also corroborated the evidence of P.Ws.1 and 2 as regards the incident.
