CRIMINAL REVISION CASE No.100 of 2013
ORDER:-
This revision is directed against the order dated 19.12.2012 passed in Crl.M.P.No.1085 of 2012 in Crime No.370 of 2012 on the file of I Addl. Asst. Sessions Judge, Rangareddy District at L.B.Nagar whereby and whereunder the learned I Addl. Asst. Sessions Judge dismissed the application filed by the petitioner under Section 70 (2) of Cr.P.C.
Heard learned counsel appearing for the petitioner and perused the order impugned in the revision.
It is contended by learned counsel appearing for the petitioner that the petitioner could not be present on the schedule date since he fell ill.
As seen from the order impugned in the revision, the petition came to be dismissed for default. Nothing prevents the petitioner to appear before the I Addl. Asst. Sessions Judge, Rangareddy District at L.B.Nagar and move an application to recall N.B.W. I do not see any illegality or irregularity in the order impugned in the revision.
Accordingly, the Criminal Revision Case is dismissed.
