ORDER:
The petitioner is A-13 in S.C.No.402 of 2011 on the file of Court of I Addl. District and Sessions Judge, Chittoor District. The petitioner approached this court seeking bail by moving successive applications. The latest bail application being Crl. Petition No.4507 of 2012 dated 05.06.2012.
Heard learned counsel appearing for the petitioner and learned Addl. Public Prosecutor appearing for the respondent-State.
It is contended by learned counsel appearing for the petitioner that inspite of the direction given by this court in Crl. Petition No.2860 of 2012, trial of the case is not being proceeded and therefore, the petitioner deserves for grant of bail.
Learned Addl. Public Prosecutor opposed the application on the ground that the proceedings in the trial court are being delayed because some of the accused moving applications for discharge and the discharge applications have been ended in dismissal as on this day.
I have gone through the orders passed earlier, rejecting bail to the petitioner. Taking note of the accusations levelled against the petitioner, the earlier bail applications came to be dismissed. The delay of the proceedings cannot be attributed to the prosecution since some of the accused filed applications for discharge and their applications ended in dismissal. Therefore, I do not see any change of circumstances that enure to the benefit of the petitioner to renew his request for grant of bail.
Accordingly, the Criminal Petition is dismissed.
