CRIMINAL PETITION NO. 5141 OF 2010
ORDER:
1. This Criminal Petition is filed by the petitioner/A2 under Section 482 of Code of Criminal Procedure, 1973 (for short “Cr.P.C.”) to quash the investigation in F.I.R. No.87 of 2010 of Pithapuram Police Station, East Godavari District for the offences punishable under Sections 420 and 506 read with 34 of IPC.
2. When the matter is taken up for hearing, the learned counsel for the respondent No.2 submitted that the police have already investigated into the matter and filed charge sheet, which was taken on file as C.C.No.5 of 2011 on the file of Judicial First Class Magistrate, Pithapuram.
3. In view of the fact that the police have already filed charge sheet, nothing survives for consideration in the present petition.
4. Accordingly, the Criminal Petition is dismissed as infructuous. The miscellaneous petitions, if any, pending shall stand closed.
