A private complain was filed by the unofficial respondent in both the criminal petitions against the petitioners herein and others alleging as under: According to him, he filed OS No.753/2008 on the file of Judicial Magistrate of First Class, Nidadavole against five persons for permanent injunction restraining them from interfering with the peaceful possession and enjoyment of the land. The said court granted ad-interim injunction and later made it absolute. It is stated that on coming to know about the said orders, some persons in the village started threatening the respondent stating that they would trespass into the land and spoil the sugar-cane crop standing in his land. It is alleged that at about 4 or 5 months prior to lodging of the complaint, 34 persons with the active instigation and support of the petitioners herein, armed with knives and axes, highhandedly trespassed into the land, removed the sugar-cane standing and threw the same into Godavari river. They have also cut the fruit bearing banana trees and committed theft of banana fruit bunches. In respect of the said incident, the respondent herein filed a case against 37 persons, which was taken on file as CC No.705/2008 on the file of Judicial Magistrate of First Class, Nidadavole. It is further alleged that on 24-11-2008, the accused 1 to 5 with the active support and instigation of the petitioners herein trespassed into the place of offence and committed criminal and illegal acts. It is alleged that A-1 to A-5 along with 100 persons trespassed into the said land, dug the pit in the middle of land, placed the dead body of the mother of A-1 and A-2 in a box and performed the death ceremonies in the place of offence ie., the land
