3 On 26.04.2006 the petitioner herein borrowed an amount of Rs.1,50,000/- from the complainant for his business expenses and evidencing the same the petitioner is said to have executed two promissory notes for Rs.75,000/- each in favour of the complainant agreeing to repay the same with interest at the rate of 2% p.m. After repeated demands made by the complainant, the petitioner is said to have issued a cheque bearing No.346169 dated 15.12.2008 for Rs.95,000/- drawn on HDFC Bank, Guntur in favour of the complainant towards part payment of the debt. It is further stated that when the complainant presented the said cheque on 30.12.2008 in Andhra Bank, Brodipet branch, Guntur for encashment the said cheque was returned dishonoured on 13.01.2009 for the reason ‘account closed’. The same was intimated to the complainant on 19.01.2009 along with bank memo dated 19.01.2009. Thereafter, the complainant got issued a notice on 31.01.2009 demanding repayment of amount covered under the cheque. Having received the notice on 07.02.2009, the petitioner did not choose to pay anything to the complainant and even did not give any reply to the notice. Basing on these allegations, a private complaint was filed against the petitioner, which was taken on file as C.C.No.344 of 2009.
