Petition under Sections 437 & 439 of Cr.P.C., praying that in the circumstances stated in the memorandum of grounds filed herein, the High Court may be pleased to grant regular bail to him in connection with Crime No.31 of 2013 of Akivedu Police Station.

The Court made the following Order:

The petitioner is A-10. He allegedly committed an offence under Sections 489-B and 489-C IPC. He seeks for grant of bail.

The learned counsel for the petitioner contended that the petitioner has been in jail for over 100 days and that charge sheet has already been filed.

The learned Public Prosecutor on the other hand submitted that A-10 is the key-person in distribution of the fake currency.

A-11, A-17, A-18, A-24, A-31 and A-32 were granted bail by this Court on 29.5.2013 through orders in Criminal Petition No. 3798 of 2013. The learned counsel for the petitioner contended that A-10 stands on the same footing as the other accused who were already granted bail.

It may be recalled that the Public Prosecutor however, contended that A-10 is the key-architect of the crime and that he cannot be equated with the other accused.

Be that as it may, where the petitioner has been in jail for over 100 days and that charge sheet has already been filed, I consider it appropriate to enlarge the petitioner on bail. However, where it is contended by the learned Public Prosecutor that the petitioner is the key-architect of the crime, I consider it appropriate to enlarge the petitioner on bail only on terms.

Accordingly, this Criminal Petition is allowed. The petitioner is enlarged on bail on a personal bond of Rs. 10,000/- (Rupees Ten Thousand Only) with two sureties in a like sum each to the satisfaction of II Additional Judicial Magistrate of First Class, Bhimavaram, West Godavari District. After his release, the petitioner shall appear before the Station House Officer, Akiveedu, for a period of three months.”
