Petition under Section 438 of Crl. P.C praying that in the circumstances stated in the petition and the memo of grounds filed herein, the High Court may be pleased to direct the Station House Officer, Narasapur Town Police Station, West Godavari District to release the petitioner on bail in the event of his arrest in connection with Crime No. 148 of 2013 of Narasapur Town Police Station, West Godavari District.
THE COURT MADE THE FOLLOWING ORDER :
“This criminal petition, under Section 438 Cr.P.C., has been filed by the petitioner/accused seeking anticipatory bail in connection with Crime No.148 of 2013 on the file of Narsapuram Town Police Station, West Godavari District, registered for the offences punishable under Sections 306, 354(D) and 506 read with 34 IPC.
Heard both the learned counsel.
Having regard to the allegations made against the petitioner, the age of the petitioner and other facts and circumstances of the case, I am inclined to grant bail to the petitioner.
In the result, this Criminal Petition is allowed. The petitioner is directed to surrender before the Investigating Officer, within two weeks from today and on such surrender, he shall be enlarged on bail on his executing a personal bond for a sum of Rs.10,000/(Rupees ten thousand only) with two sureties for a like sum each to the satisfaction of the Investigating Officer. After release, the petitioner shall report before SHO, Narsapuram Town Police Station, West Godavari District, on every day between 05.00 PM and 07.00 PM until further orders. The petitioner shall not directly or indirectly threaten any witnesses acquainted with the facts of the case. If the petitioner violated any terms and conditions of this order the prosecution is at liberty to file an application for cancellation of bail of the petitioner.
