ORDER:
This Contempt Case has been filed to punish the respondents under Sections 10 to 12 of the Contempt of Courts Act, for wilful and deliberate disobedience of the orders dated 14.12.2011 passed by this Court in W.P.No. 30246 of 2011.
Petitioner filed the Writ Petition seeking to declare the action of the respondents in issuing the impugned proceedings dated 30.7.2009 issued by the 4th respondent and proceedings dated 6.9.2011 of the second respondent in imposing a major punishment of deferment of annual increment for a period of two years with cumulative effect as illegal and arbitrary. By order dated 14.12.2011, this Court allowed the Writ Petition by setting aside the impugned proceedings dated 30.7.2009 and 6.9.2011 passed by the 4th and 2nd respondents respectively and remitted the matter to the 4th respondent-Corporation to pass appropriate orders after issuing show cause notice to the
petitioner.
This Court ordered notice before admission on 3.12.2012. Again on 24.12.2012 dispensed with the presence of the first respondent and ordered notice against 4th respondent for his appearance. Hence, the case was directed to be posted today for the appearance of the 4th respondent.
The 4th respondent is present physically before this Court.
The learned Standing Counsel appearing for the 4th respondent submits that due to communication gap between the 4th respondent and himself, there was no representation on behalf of the 4th respondent on 24.12.2012 and therefore, his presence may be taken note of and further appearance be dispensed with. He also further submits that in compliance of the order passed by this Court, the 4th respondent, who is the Depot Manager of the APSRTC, Sircilla Depot, issued the proceedings dated 8.12.2012, a copy of the same has been placed
before this Court, and the counsel appearing for the petitioner also does not dispute the same. In view of the above, no further orders need be passed in this Contempt Case and accordingly, the Contempt Case is closed.
