JUDGMENT:

This contempt case was instituted alleging disobedience to the order dated 27.08.2012 passed by this Court in W.P.M.P.No.29293 of 2012 in W.P.No.22927 of 2012. By the said order, the Primary Agricultural Cooperative Society, Khanapur, Adilabad District was directed to pay subsistence allowance to the petitioner for the period that he was kept under suspension within a time frame.

2. Today, Sri M.Ramgopal Rao, learned counsel for the President of Primary Agricultural Cooperative Society,

Khanapur, Adilabad District produced proceedings dated 02.02.2013 addressed by the President of the Society to the Divisional Cooperative Officer/Deputy Registrar of Cooperative Societies, Nirmal, Adilabad District stating that the petitioner was under suspension from 12.04.2001 to 10.01.2004, when he was removed. The subsistence allowance payable to him was quantified at Rs.54,400/and deducting the sum of Rs.10,350/- already paid to him, the balance payable of Rs.44,050/- was held to be due. The President of the Society informed the Divisional Cooperative Officer, Nirmal Adilabad District that the said amount was being paid as per the rules and subject to the outcome of the surcharge proceedings pending before the Cooperative Tribunal. The learned counsel handed over cheque No.008545, drawn on Adilabad Cooperative Central Bank Limited, Adilabad for a sum of Rs.44,050/-, to the petitioner.

3. In the event the petitioner has any dispute as to the quantum of the subsistence allowance to be paid to him, he would necessarily have to canvass the same by way of independent proceedings and cannot do so in this contempt case.

4. Subject to the above observation, the contempt case is closed. No costs.
