ORDER:
Counter not filed. Perused the petition contents.
Under Clause 24 of the Agreement, in case of any dispute, the matter should be referred to an arbitrator, who shall be the retired Judge of the High Court of Andhra Pradesh, as may be agreed by both the parties.
Since, the material furnished by the petitioner shows an arbitrable dispute and as the respondent has not suggested the arbitrator nor denied the arbitrable dispute, Sri Justice A. Hanumanthu, retired Judge of the High Court of Andhra Pradesh, is appointed as an arbitrator and he shall be paid fee etc., as per the Indian Arbitration Council Rules. Initially both the parties are directed to deposit a sum of Rs.10,000/- (Rupees Ten Thousand only) each.
Accordingly, the Arbitration Application is allowed.
