ORDER (per Hon’ble Sri Justice Goda Raghuram):
At the hearing in this writ petition, on a query from this Court, the learned Government Pleader for Transport, appearing for the respondent, has fairly conceded on the legal position, that the demand notice dated
31-03-2000 (impugned in the writ petition) cannot be sustained in view of the judgment of the Larger Bench of this Court in L.Royal
Reddy and Others Vs. Government of Andhra Pradesh and Other s[1] , wherein this Court declared that when vehicles are found plying in violation of permits issued under the M.V.Act, 1988, respondents are clothed with sufficient powers and shall be entitled to take action against such violations; Motor Vehicles tax is compensatory in nature and not ex-proprietary; and Tax cannot be levied as a fine or penalty for contravention of permit conditions and as such, penalty cannot be treated as part of recovery of compensatory
tax.
In view of the said submission, the writ petition is allowed as
prayed for. No costs.
