Counter affidavit is filed by the Sub-Inspector of Police, Malkapuram Police Station of Visakhapatnam City. In the counter, while denying the allegations of the petitioner, it is stated that the petitioner was accused in Crime No.78 of 1993, registered for the offences under Sections 365, 354, 341, 347, 387, 392, 307 r/w.34 of IPC on the file of IV-Town Police Station, Visakhapatnam City. It is stated that in connection with the said crime, the petitioner was tried in S.C.No.231 of 1993 before the I- Additional Metropolitan Magistrate Court at Visakhapatnam and was convicted and sentenced to undergo Rigorous Imprisonment for three years. Against the said conviction, the petitioner has filed an appeal in Criminal Appeal No.334 of 1997 before this Court, which was partly allowed, reducing the sentence and the same was also confirmed by the Hon’ble Supreme Court. In the counter, it is further stated that in view of the Memo issued by the Commissioner of Police, Visakhapatnam, dated 12.12.2011, a rowdy sheet is opened against the petitioner as he is creating law and order problem in Malkapuram Police Station limits, but no one is coming forward to lodge a specific complaint.
