ORDER :

1. This Writ Petition is filed seeking to issue a writ of mandamus declaring action of the respondents in widening roads by demolishing the building bearing D.No.2-9-16/6, Tadepalligudem, West Godavari District of the petitioner without any notification, without payment of compensation and without initiating any action as per law as illegal and arbitrary, and consequently direct the respondents not to demolish the building of the petitioner for the purpose of road widening without following due process of law.

2. Heard the learned counsel for the petitioner and the learned standing counsel appearing for the respondents.

3. The grievance of the petitioner is that without following due process of law, the respondents are trying to demolish the building in question belonging to him for the purpose of road widening.

5. On the other hand, the learned standing counsel appearing for the respondents states that if the land of the petitioner is required for road widening purpose, after following due process of law, removal of the building will be effected.

6. The petitioner claims that he is owner of the building in question. It is his case that without issuing any notices, the respondent authorities are trying to demolish the building for road widening purpose. If the petitioner is

owner of the building in question, the respondents have to follow due process of law contemplated under the Municipalities Act. Unless the procedure contemplated under law is followed, demolition shall not take place.

Therefore, the Writ Petition is disposed of directing the respondents to follow due process of law before demolishing the building of the petitioner, if the same is required for road widening purpose. The petitioner is directed to produce copy of the title document before the respondent authorities. No costs.
