Petitioner is the owner of house bearing D.No.40-20-99 situated at Nirmala Convent Road, near N.T.R. Statue, Vijayawada. He constructed the house in the year 1992 after obtaining approval plan from respondent No.2 – Corporation. As per the approval plan, the petitioner was permitted to raise construction including shops in the ground floor. While the matter stood thus, the Vijayawada Municipal Corporation took up road widening proposal at Nirmala Convent road. The Corporation called upon the affected owners to surrender their properties for road widening purpose. By notice, dated 14.10.2011, respondent No.2 convened a meeting to finalize the procedure to be adopted for taking the land and for payment of compensation, and asked the owners to come along with building plan and documents on 15.10.2011. In the said meeting, the Corporation decided to widen Nirmala Convent road up to 70 feet width and proposed to pay compensation amount to the building owners by way of TDR Bonds.
