The petitioner is the owner of Auto Rickshaw bearing Registration No.AP.25-V-3984. On 16.12.2011, he gave his auto rickshaw to a mechanic, namely, Shaik Irfan, for repairs. After completion of repairs, when the mechanic was bringing the auto rickshaw to his house, in the middle of the way near APSRTC Bus Stop, Adilabad, respondent No.2 herein stopped the said auto and asked the relevant documents. Even though the mechanic informed respondent No.2 that he would produce the documents by calling the petitioner, respondent No.2 seized the auto rickshaw under Vehicle Check Report No.1130553 dated 16.12.2011. Immediately, he rushed to respondent No.2 and produced all relevant documents. Due to financial problems he could not pay the tax from 30.09.2009 to till date. Respondent No.2 informed him to pay the tax of Rs.990/- and penalty of Rs.1980/-, totaling Rs.9,625/-. Since he is a poor person and was not in a position to pay the said amount, he gave a representation to respondent No.1 requesting to release his vehicle and to exempt him from paying the said amount. But, no action has been taken on the said representation so far. Hence, this writ petition.
