2. The brief facts, stated in the affidavit filed in support of the writ petition, are that the petitioner occupied the aforementioned Government land thirty years back. Recognizing the possession of the petitioner, the Government gave Sagubadi patta thirty years back and since then, the petitioner is cultivating the same by paying cist to the Government and also constructed a shed in the said land and living there with his family. The Tahsildar, Atchuthapuram Mandal issued ‘B’ Memos for the said land. While so, on 01.12.2011, the officials of respondent No.1 along with respondent No.2 came to his land and took measurements stating that they are going to lay 40 feet road in Sy.No.125 from Bhogapuram to Chakirevula Gadda through his land to lay approach road to Sy.No.124 of Bhogapuram Village. To approach Sy.No.124, already there is a 200 feet road from Chakirevugadda to Atchuthapuram and another road from Maduturu and there already exists another 10 feet rashta in Sy.No.125 to the east of his land from Bhogapuram pucca road to Chakirevula Gadda road, which can be used by plot owners in Sy.No.124. The petitioner is eking out his livelihood by cultivating the land. If respondent No.1 lays a road through the land of the petitioner without following due process of law, he would suffer serious loss and great hardship. Hence, he filed the present writ petition.
