Since the petitioner has made allegations against the Tahsildar, including of his having filed a malicious criminal complaint, I consider it appropriate to direct the District Collector, Karimnagar, who is the first respondent in C.C.No.197 of 2012, to cause an enquiry into the genuineness or otherwise of the possession certificate dated 08.07.2002 after putting the parties concerned on notice, and after giving them an opportunity of being heard. The District Collector shall pass a reasoned order in accordance with law, and only thereafter, if need be, take further action under the provisions of the Andhra Pradesh Land Encroachment Act. It is made clear that, till orders are passed by the District Collector in terms of the directions issued hereinabove, neither should any action be taken against the third respondent in C.C.No.197 of 2012 under the provisions of the Andhra Pradesh Land Encroachment Act, nor shall the third respondent make any further constructions over the land in question. The entire exercise, culminating in an order being passed by the District Collector, shall be completed within a period of two months from the date of receipt of a copy of this order.
