ORDER: (per the Hon’ble the Acting Chief Justice Sri Pinaki Chandra Ghose)

This writ petition is filed to declare the action of respondent Nos.1 to 3 in not preventing the demolition of the protected heritage structure at new H.No.471, Road No.4, Banjara Hills, Hyderabad, which was mentioned at Sl. No.21 Code 3.34 in G.O. Ms. No.102, dt.23.3.1998, as illegal and unconstitutional, and consequently to direct the respondents to restore the heritage building in question to its pristine glory while initiating steps to punish the persons responsible for demolition of the structure.

At the time of hearing of the writ petition, it is brought to the notice of this Court that an application dt.29.6.2011 has been filed in the matter by Gavva Estates Private Limited, Hyderabad, before the Principal Secretary, Municipal Administration and Urban Development, Government of Andhra Pradesh, Hyderabad, for delisting of the building bearing Municipal No.8-2-413 admeasuring 3292.25 Sq.Mtrs or 3938 Sq.yards, situated at Road No.4, Banjara Hills, Hyderabad, from the list of Heritage properties, and the said application is pending consideration.

Having heard the learned counsel for the parties and having perused the material available on record, since the above said application dt.29.6.2011 is pending consideration before respondent No.1, we direct the said authority to consider the application

dt.29.6.2011 and pass a reasoned order in the matter in question as expeditiously as possible, in accordance with the provisions of law. Status quo as on today shall be maintained until the matter is decided by respondent No.1.

The writ petition is accordingly disposed of. No costs.
