This writ appeal is directed against the order dt.14.9.2012 passed by the Hon’ble Single Judge, in W.P. No.27141 of 2012.

The appellants – writ petitioners filed the writ petition to declare the action of the respondents in not providing protection to the petitioners’ land an extent of Ac.2.00 cents in R.S. No.224/1 and Acs.2.04 cents in R.S. No.224/2 situated at Kamaiahpalem Village, Jeelugumilli Mandal, West Godavari District, as illegal and arbitrary and consequently to direct respondent No.1 – Revenue Divisional Officer to arrange necessary protection to the petitioners lands.

The Hon’ble Single Judge after considering the matter dismissed the writ petition leaving it open to the writ petitioners to avail remedies under law.

Being aggrieved and dissatisfied with the said order passed by the Hon’ble Single Judge, this writ appeal is filed.

It appears that the appellants – petitioners on 13.8.2012 applied before respondent No.1 - Revenue Divisional Officer, requesting to provide protection to the properties in question. Respondent No.1 has already passed an order in the matter on 25.8.2012 which was also intimated to the Station House Officer, Jeelugumilli Police Station, Jeelugumilli. Therefore, it appears that the appellants - petitioners have already got the benefit of having the protection as directed by

respondent No.1. It appears to us that respondent No.1 also acts with judicial authority in respect of giving such protection in a case as identical to that of the appellants.

In these circumstances, the order so passed by the Hon’ble Single Judge in the matter that the petitioners can approach the appropriate authority only give liberty to the appellants - petitioners to apply before respondent No.1 – Revenue Divisional Officer, who has already passed an order in the matter. He shall take necessary steps in the matter in accordance with law.

The writ appeal is disposed of on the above terms. No costs.
