ORDER:

This writ petition is filed for the following substantive relief:

“… Hon’ble Court may be pleased to issue a writ of Mandamus or any other appropriate writ, order or direction, declaring the action of the 5^th respondent herein in not completing the investigation in the Crime in FIR No.79 of 2012 and not filing the charge sheet as illegal, arbitrary, unreasonable and violative of Article 14 of the Constitution of India and opposed to the very spirit and object of the provisions of the Code of Criminal Procedure and consequently direct the 5^th respondent herein to complete the investigation in the Crime in FIR No.79 of 2012 and file charge sheet.”

Heard both sides.

The learned Assistant Government Pleader for Home, on instructions, submitted that the investigation is under progress and the 5^th respondent will file report, as contemplated under Section 173 Cr.P.C.

There cannot be any dispute that when a cognizable offence is registered against an accused, it is the statutory duty of the police to conduct investigation and complete the same as expeditiously as possible without any delay. As there was some progress in the investigation, a reasonable time can be granted to the 5^th respondent for filing report, as contemplated under Section 173 Cr.P.C.

Hence, the Writ Petition is disposed of directing the 5^th respondent to file a report within a period of six weeks from the date of receipt of a copy of this order. No costs.

As a sequel, miscellaneous petitions, if any, pending in this writ petition shall stand closed.
