Heard learned counsel for the petitioner; learned Government Pleader for Panchayat Raj appearing for respondent Nos.1 and 3; and Sri M.Subrahmanyam, learned Standing Counsel for respondent No.2.

Petitioner has questioned the order of removal passed against him by the Project Director-respondent No.1, dated 08.06.2011, alleging misuse of funds of S.R.D.S.

Learned counsel for the petitioner states that he had submitted detailed explanation and if that is taken into consideration, it cannot be said that petitioner is in any way responsible.

It is, however, evident that petitioner has straight away approached this Court without exhausting the efficacious alternative remedy of appeal against the impugned order. Since the petitioner raised several factual questions for adjudication, it is just and appropriate to dispose of the writ petition relegating the petitioner to the appellate remedy.

Learned Standing Counsel appearing for respondent No.2 states

that against the order of respondent No.1 appeal lies to the Member Secretary, S.R.D.S. as per Rules.

Hence, the Writ Petition is disposed of giving liberty to the petitioner to file an appeal before the appellate authority within two weeks from today and if such appeal is preferred, the same shall be considered without raising objection as to limitation and shall be disposed of on merits by the appellate authority in accordance with law. There shall be no order as to costs.
