Even from the submissions made by the learned Government Pleader, it is clear that originally the land was assigned in the name of one Boya Narasappa as early as on 26th January 1929, and thereafter, several transactions had taken place between 1958 and 1986. Further, it is to be noticed that prohibition of alienation of assigned lands has come into force only by virtue of Government Orders in G.O.Ms.No. 1142, Revenue, dated 18.06.1954, but as the land in question was assigned in 1929 itself without any condition, there cannot be any impediment for accepting the document for registration. As it is submitted that the document was not at all presented for registration, I deem it appropriate to dispose of the writ petition permitting the petitioner to submit the document i.e. agreement of sale with regard to land covered by Sy.No.842 admeasuring 18.25 cents, situated at Chilamattur village and Mandal of Anantapur District, in which event, the 3rd respondent shall accept the same and consider it for registration without raising any objection on the ground that the said land was originally assigned land, provided the document is in accordance with the provisions of the Indian Stamp Act, 1899 and the Registration Act, 1908.
