From a perusal of the draft declaration published on 08.05.2012, which is filed in the material papers, it is clearly evident that the lands of the petitioner are needed for a public purpose to wit, for access, and for providing road from Hameedullahnagar Road Shamshabad Interchange of Outer Ring Road. Even in the counter affidavit, it is stated that the lands of the petitioners were notified for acquisition for formation of link road from Hamidullahnagar Outer Ring Road to Shamshabad. In view of this, it cannot be said that the public purpose for which the lands in question are sought to be acquired is vague. Merely on the ground that the land of one of the family members of the petitioner was earlier acquired for public purpose, but subsequently the same was not used for the purpose for which it was acquired, the genuineness of the public purpose for which the subject land is required cannot be doubted. Further, as no other ground is urged to invalidate the impugned notifications, I do not find any illegality to interfere with the matter and the writ petition is therefore devoid of merits.
